TERMS OF SERVICE — GROUNDGRABBA
(Includes Section 0 which supersedes conflicting clauses in all other sections)
SECTION 0 – GROUNDGRABBA-SPECIFIC TERMS (Supersedes Conflicting Clauses)
These additional terms apply to all purchases of GroundGrabba products and override any conflicting wording elsewhere in this Terms of Service document.
0.1 Personal Use vs Commercial Use
Purchases are classified as personal use when they are made by an individual for private, recreational, household, or lifestyle use and no engineering advice or compliance requirements exist.
Purchases are classified as commercial use when one or more apply:
- The buyer is a business, organisation, builder, tradie, contractor, or engineer
- A Purchase Order (PO) is used
- Engineering advice, suitability guidance, or compliance documentation is requested
- The product is used for income generation (Airbnb, rentals, farm stays, site offices, jobsite accommodation, etc.)
- The product is used for commercial, industrial, structural, or load-bearing applications
Commercial-use orders follow stricter returns, warranty, and shipping conditions.
0.2 No Engineering Advice or Structural Guarantees
GroundGrabba does not provide engineering advice and does not guarantee:
- suitability for a specific structure, load, or building design
- suitability for any specific soil, substrate, geology, or environmental condition
- uplift, shear, overturning, wind, or structural performance
- compatibility with customer-designed bases, poles, footings, or leverage conditions
The customer is solely responsible for:
- soil and ground assessment
- engineering and load calculations
- base and structural design
- determining fitness for purpose
- compliance with building codes, standards, and local laws
GroundGrabba cannot be held liable for any structural outcome resulting from customer decisions.
0.3 Misuse & Incorrect Application (Warranty Exclusions)
Warranty, refunds, and liability do not apply where products are:
- hammered or struck into the ground
- used outside their intended purpose
- driven with an impact wrench (GroundGrabba Lite only)
- used in unsuitable soil conditions
- over-tightened or subjected to excessive leverage
- installed contrary to GroundGrabba instructions
GroundGrabba products are designed to be screwed into the ground using appropriate tools; any deviation may void warranty.
0.4 Bulk Orders, Purchase Orders & Risk Transfer
For commercial quantities, bulk orders, or PO-based orders:
- A non-refundable deposit applies once production begins
- Orders cannot be cancelled or reduced after production commences
- Risk transfers to the customer upon dispatch from our warehouse or 3PL
- Transit insurance is the responsibility of the buyer
- Used anchors cannot be returned under any circumstances
- Refunds for commercial orders apply only if goods were faulty before dispatch
GroundGrabba will assist with carrier investigations but is not liable for freight loss or delays after dispatch.
0.5 Returns & Warranty
Customers agree to our published Returns, Refunds & Warranty Policy, summarised:
Personal Use:
- 12-month satisfaction guarantee
- Returns allowed even if used (conditions apply)
- GroundGrabba covers return freight (conditions apply)
Commercial Use:
- No change-of-mind returns
- No returns of used anchors
- Bulk/PO orders are non-refundable
- Returns accepted only for verified defects
Lifetime Warranty:
Applies to:
- GroundGrabba Pro Series (steel)
- GroundGrabba Junior (steel)
- GroundGrabba-made steel accessories (Closed Hooks, Hook Washers, Pigtail Hooks, The Fang, etc.)
12-Month Warranty:
- GroundGrabba Lite
- Non-steel accessories unless otherwise stated
0.6 Shipping & Delivery Conditions
By purchasing from this website, you agree to our Shipping Policy, including:
- Shipping options, carrier choices, costs, and delivery estimates shown at checkout
- ATL (Authority To Leave) unless signature is selected
- Risk transfer for commercial orders at the moment of dispatch
- GroundGrabba is not liable for carrier delays, loss, theft, or damage after dispatch
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and you have given consent for any minors to use this site.
You may not use our products for illegal or unauthorized purposes.
You must not transmit worms, viruses, or destructive code.
A breach of these Terms may result in immediate termination of Services.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone at any time.
Content (excluding credit card info) may be transferred unencrypted over networks.
You agree not to reproduce, duplicate, sell or exploit any part of the Service without written permission.

We are not responsible for inaccurate, incomplete, or outdated information on this site.
Material is for general use only and should not be solely relied upon for decisions.
We may update content at any time but are not obligated to do so.

Prices may change without notice.
We may modify or discontinue the Service at any time without notice.
We are not liable to you or third parties for service changes or discontinuation.
SECTION 5 – PRODUCTS OR SERVICES
Products available online may have limited quantities.
Colours and images may vary depending on your monitor.
We reserve the right to limit sales or discontinue products at any time.
We do not guarantee products will meet your expectations.
SECTION 6 – ACCURACY OF BILLING & ACCOUNT INFORMATION
We may refuse or cancel orders at our discretion.
You agree to provide accurate and up-to-date account and payment information.

SECTION 7 – OPTIONAL TOOLS
We may offer third-party tools on an as-is basis with no warranties.
Use of third-party tools is at your own risk.
SECTION 8 – THIRD-PARTY LINKS
We are not responsible for third-party content or websites.
Use of third-party sites is at your own discretion.
SECTION 9 – USER COMMENTS & SUBMISSIONS
Comments may be used by us without restriction.
You may not post unlawful, defamatory, harmful, or infringing content.
We are not obligated to maintain comments or respond to them.

We reserve the right to correct errors or inaccuracies at any time, including after orders are submitted.

You may not use the site for unlawful purposes, harassment, data scraping, uploading malware, or violating intellectual property.
SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We are not liable for damages arising from use of the Service or products.
SECTION 14 – INDEMNIFICATION
You agree to indemnify GroundGrabba against claims arising from your breach of these Terms.

Either party may terminate use of the Service.
You remain liable for outstanding amounts up to termination.
SECTION 17 – ENTIRE AGREEMENT
These Terms supersede all prior agreements and proposals.
SECTION 18 – GOVERNING LAW
These Terms are governed by Australian law.
SECTION 19 – CHANGES TO TERMS
We may update these Terms at any time.
Continued use of the site constitutes acceptance.
SECTION 20 – MOBILE TERMS OF SERVICE
Applies only if you opt in to receive SMS messages from GroundGrabba. If GroundGrabba does not offer SMS messaging at the time you use this site, this section does not apply.
